What are the alcohol limits for a DUI charge?

Driving under the influence (DUI) charges can be the result of several different scenarios. Some people get arrested because they display poor control of their vehicles. Other times, they might fail a chemical test after a traffic stop or a collision. 

A failed breath test indicates that a motorist has an illegally high blood alcohol concentration (BAC). Several different BAC limits apply to people in different circumstances. Understanding those limits could make it easier for drivers to avoid DUI charges or respond effectively to pending allegations after an arrest. 

What are the current BAC limits? 

Most adults driving their own vehicles are subject to the standard BAC limit of 0.08%. Many people notice some degree of impairment in themselves at that level. 

However, some people could be at risk of DUI charges with lower BAC levels. Professionals operating semi-trucks or other commercial vehicles are subject to a limit of 0.04%. Those driving their own vehicles as a ride-for-hire provider are subject to the same limit. 

Drivers who are on probation for prior DUI offenses and those who are under the legal drinking age are subject to a 0.01% BAC limit. If test results show that a driver is over the per se limit that applies to them, they could be at risk of arrest and prosecution. 

Understanding the rules that apply to DUI charges can help people avoid breaking the law. In some cases, challenging test results could be part of a defense strategy. Drivers who hope to avoid convictions may need to discuss their case at length to develop an appropriate response.
