When is an ignition interlock device required in California?

Ignition interlock devices (IIDs) prevent a vehicle from starting if the driver has alcohol in their system. These small breath-test devices connect to a car’s ignition and require a breath sample before operation. If the device detects alcohol above a preset limit, the engine will not start. The driver must also provide random breath samples while driving to ensure continued sobriety.

How ignition interlock devices function

The IID measures blood alcohol concentration (BAC) using fuel cell technology. If the BAC is below the legal threshold, the vehicle starts. If alcohol is detected, the device prevents ignition for a set period. To prevent tampering, many IIDs use cameras and rolling retests. Rolling retests prompt the driver to provide additional breath samples while driving. Failure to comply or an attempt to bypass the system can result in penalties.

When ignition interlock devices are required

California law mandates IIDs for certain DUI offenses. First-time offenders may need an IID for up to six months, depending on the county and circumstances. A second DUI conviction generally requires an IID for one year. Third-time offenses increase the requirement to two years, while fourth and subsequent convictions may result in a three-year IID mandate.

Applying for an IID-restricted license

Drivers with a DUI suspension can often regain driving privileges by installing an IID and applying for a restricted license. This process requires proof of installation from a state-approved provider, an SR-22 insurance certificate, and payment of applicable fees. Once approved, the driver must comply with all testing requirements and maintain the IID for the designated period.

What happens if someone fails or skips an IID test?

Failing a breath test or missing a rolling retest can lead to penalties, including an extended IID period or license suspension. Any attempt to remove or tamper with the device can result in additional legal consequences.
