What defenses exist for DUI charges involving medications?

On Behalf of | Jan 14, 2025 | Drug Charges

Driving under the influence (DUI) charges in California do not only apply to alcohol. Operating a vehicle while impaired by prescription medications can also lead to legal consequences. However, there are potential defenses available to fight these charges.

Prove you were not impaired

One defense involves demonstrating that the prescription medication did not impair your ability to drive safely. Expert testimony or medical evidence may show that the medication’s effects were within acceptable limits and did not contribute to unsafe driving behaviors.

Challenge the traffic stop or arrest

A law enforcement officer must have a valid reason to pull you over, such as observing erratic driving or a traffic violation. If the officer lacked reasonable suspicion or probable cause, you may be able to challenge the traffic stop and subsequent arrest in court.

Address faulty field sobriety tests

Field sobriety tests (FSTs) can be unreliable indicators of impairment, particularly for individuals taking prescribed medications. Certain medical conditions, fatigue, or nervousness may affect performance on these tests. Highlighting these factors can weaken the prosecution’s case.

Question the chemical test results

Chemical tests, like blood or urine analyses, are not always accurate in determining impairment. Medication levels in your system may not correlate directly with impaired driving. Contesting the validity of these test results or the way they were administered can serve as a defense.

Show lawful use of the prescription

California law does not penalize lawful prescription medication use unless it impairs driving. Providing proof of a valid prescription and demonstrating that the medication was taken as directed may help refute claims of improper use.

Defenses against DUI charges involving prescription medications depend on the specifics of the case. Drivers accused of DUI should understand their rights and options to protect themselves against unjust charges.
